Senior Legal Counsel - Financial Services Regulation and AML
Job Description
Key accountabilities
Include (but are not limited to):
- developing and implementing the operating policies and procedures to ensure compliance by the different entities and/or branches within the Accenture group in Luxembourg (including CSSF and CAA) and their employees (including assigned employees from the Accenture group) with the applicable rules, regulations, and internal policies, particularly relating to financial services regulation and AML/KYC/CTF.
- developing and maintaining a risk assessment the regulated entities in Luxembourg specifically in relation to financial services and AML/CTF regulation.
- overseeing compliance governance program, including reviewing, and preparing compliance reports for the regulated entities, as well as any relevant management committees and the board of directors on all compliance matters.
- monitoring day-to-day compliance, including assistance and support to the business in relation to regulatory and ad hoc compliance queries.
- assessing relevant new regulatory requirements and considering their impact on the regulated entities and its client contracts and designing and implementing compliance programmes for the regulated entities consistent with our global programmes and assessing and implementing contractual changes with the regulated entities’ clients.
- leading accountability for liaising and dealing with regulated entities (and/or its clients’) regulators including - in particular, but not limited to, the CSSF and CAA.
- working with external counsel to ensure we obtain all necessary licenses for the regulated entities, apply in time, monitor legal changes, and manage licenses appropriately.
- supervision of all regulatory licences affecting the regulated entities or other relevant Accenture group companies.
- working directly with key stakeholders across Legal to ensure we are always licensed for the provision of services.
- serving as the nominated AML Compliance Officer of Accenture’s regulated entities in Luxembourg and managing all money laundering (and/or KYC/CTF) related matters, including the investigating and assessment of alerts relating to potential money laundering risks and reporting the timely submission of reports of suspicious activity where required.
- ensuring that all customers and counterparties are screened against the list of sanctioned persons per the policies and procedures.
- developing and delivering appropriate training for Accenture employees supporting or assigned to the regulated entities on regulatory and compliance matter, particularly including AML/CTF.
Qualifications
Qualifications and experience
We are looking for the following skills:
- A practising lawyer with deep expertise (7-10 years PQE) in a financial services compliance environment, ideally in either a financial services institution or law firm advising on regulatory matters, licensing requirements and financial services regulations.
- Deep understanding of financial services regulation, anti-money laundering, KYC and CTF laws. Given the nature of the role, experience of insurance regulation and regulatory obligations of a licensed broker in France will be a key differentiator.
- Experience of liaising and dealing with relevant regulators including - in particular, but not limited to - Commission de Surveillance du Secteur Financier (CSSF) and the Commissariat aux Assurances (CAA).
- Good legal and commercial judgement skills and ability to proactively find practical solutions.
- Ability to work collaboratively with internal Accenture Leadership and teams including our Financial Services business, Business Operations, Corporate Functions, and other Legal teams (including AML, Sales & Delivery, Contract Management, Geographic Compliance & Corporate and our Gallia Market Unit Legal Director).
- Contract negotiation and management, including service level arrangements. Experience in the negotiation of outsourcing contracts and Master Services Agreements would be an advantage.
- Engagement with clients and client relationship management.
- Excellent verbal, written and interpersonal skills with the ability to interface with all levels of management and staff.
- Strong leadership and management skills. The role requires the management of personnel in offshore locations and consequently, the ability to develop and engage the team and encourage a collaborative environment is a key factor.
- Team player with strong time management, prioritization, and organisational skills.
- Excellent oral and written skills. Accenture is an English language company so proficiency in English is required.
